1.1 These Terms and Conditions are applying for nordichills.eu client (hereafter Client) and Nordic Hills OÜ (hereafter nordichills.eu) relating to the sale and purchase of products on the website www.nordichills.eu. All sales transactions are effectuated on a legal basis. These terms and conditions are considered as a Sale and Purchase Agreement between the Client and Nordic Hills OÜ.
1.2 The sale and purchase of products via www.nordichills.eu will be governed by the following Terms and Conditions for all registered users of nordichills.eu and guests who wish to purchase products via this website. These can not contradict the law of the Republic of Estonia and can be supplemented with additional provisions (information about services, goods, prices).
1.3 nordichills.eu reserves the right to unilaterally amend the Terms and Conditions of the online store www.nordichills.eu, change the terms of sale, prices, products, etc. All changes become effective from the moment of updating this website.
1.4 If the Customer has placed an order before the amendments to the provisions come into force, then the terms of purchase in force at the time of the order will apply for the order , unless otherwise provided by the law of the Republic of Estonia or herein.

2. PRODUCTS PRICE
2.1 All prices of the products in www.nordichills.eu online store are in EURO (€) and include VAT.
2.2 The shipping cost is not included in the price of product and it depends on the selected method of delivery and stated in the invoice.
2.3 The prices can be changed by nordichills.eu at any time without notice.
2.4 If an order was done before the price change, the product will still be charged at the rate prevailing at the time of the order. nordichills.eu shall not refund the difference in price of products.
2.5 The final order price displayed in the personal shopping cart.

3. ORDER AND PAYMENT
3.1 nordichills.eu/ Nordic Hills OÜ is a seller and Client of the web site www.nordichills.eu is a buyer.
3.2 To order goods, the Client should add the desired products to the shopping cart. To complete the order, to fill in the required data fields and choose the appropriate delivery method. The amount of the fee can then be displayed, which can be paid by Internet via a bank link.

3.13 Nordic Hills OÜ is the main processor of personal data, Nordic Hills OÜ transfers personal data necessary for making payments to the payment centre Montonio.

4. DISPATCHING AND DELIVERY
4.1 After payment of the order, the products will be dıspatched to the Client in accordance with the chosen delivery method. The Client can receive the processed order at the pick-up point, or via parcel machine, or by courier service indicated on the website www.nordichills.eu.
4.2 The estimated delivery time is valid from payment of the order and depends on the product availability, shipping method and a delıvery location. If any product is out of stock after the order placement, nordichills.eu will inform the Client as soon as possible using the Client's contact details.
4.3 In case the Сlient would like to change delivery address, it is necessary to inform nordichills.eu as soon as possible. Client is responsible to inform nordichills.eu of any address or other relevant details change. If the order has already been shipped to the specified address, the delivery location cannot be changed.
4.4 In the case of placing an order via a parcel machine or by courier service, after dispatching the parcel nordichills.eu sends a corresponding notification to the Client's email address.
4.5 If the Client picks up the processed order at the pick-up point, nordichills.eu sends a corresponding notification to the Client's email address to confirm readiness of the order.
4.6 Delivery and proper shipping depend on how precise is the information provided by the Client. The products will be delivered properly, if the order has been correctly placed. nordichills.eu is not responsible for any delivery delays or information mistakes due to inaccurate or incorrect data provided by the Client when placing an order.
4.7 nordichills.eu has the right to adjust and amend these delivery terms at any time.

5. WARRANTY AND RETURNS
5.1 All products in nordichills.eu online store are 100% original. Product images are for illustrative purposes only. Product images on the website may differ from the actual product by product's color, size and other parameters from the product image displayed on the nordichills.eu. Each product has a description on the website and on the package.
5.2 According to the Law of Obligations of the Republic of Estonia, the Client has 14 days from the delivery of the parcel to return it to nordichills.eu. In case of the order return, the product should be in same condition in which it was dispatched by nordichills.eu. Returned product must be undamaged, unused, originally labelled and in the unopened original packagе. nordichills.eu will not accept to refund the order price to Client, if the returned product is damaged, soiled, incomplete and/or has a damaged package.
5.3 When returning goods, the Client must submit a free-form application to the email address info@nordichills.eu within 14 days from the date of receipt of the order. The application must indicate: the reason for the return, the name and surname of the Client, the name of the product, as well as the order number.
5.4 If at the moment of the product receipt a defect is discovered or the received product does not correspond to the order, the Client is obliged to notify nordichills.eu of this by sending an email to info@nordichills.eu with the following information: the Client's name and surname, contact details, date, alleged defect of the product (preferably with a photo), invoice number or its copy. The corresponding application must be sent no later than 14 days after the discovery of the defect but no later than 30 days after the Client receives the product.
5.5 nordichills.eu is not responsible or liable in defects that appeared as a result of fault or negligence of the Client’s use, due to the fault or negligence of the Client, if using the goods for other purposes, not complying the storage terms; due to natural physical wear and tear during normal use.
5.6 The Client shall pay the costs of shipping the returned products. nordichills.eu pays for the delivery of the returned products only if the products were defective or did not match the order.
5.7 If all the mentioned conditions are complied, refund for the returned product and return delivery, if agreed, will be done within 30 days from the moment nordichills.eu receives the returned product.
5.8 If the Client would like to exchange product to a different one or the same product but a new one, the Client is responsible for the delıvery fees as per the chosen shipping method. An exception is the case when a defective or non-conforming product is replaced.
5.9 In the case of delivery via a parcel machine or by courier service, if the product and/or its package was damaged while delivery to the Client, then nordichills.eu has the right to replace this product with a new one. If replacement is not possible (due to lack of goods), nordichills.eu pays the Client the cost of the damaged goods.
5.10 If the product has defect that was impossible to detect by external examination and that did not appear at the opening of the package but no later than 30 day after the Client received the product, nordichills.eu has the right to reduce the price of the product ordered or completely refund the cost of product to the Client subject to agreement between the both Parties.

6. LIABILITY AND FORCE MAJEURE
6.1 nordichills.eu is liable to the Client for any damage resulting from violation of the conditions by nordichills.eu in accordance with the legal acts of the Republic of Estonia.
6.2 The Client is liable to nordichills.eu for any damage resulting from violation of the conditions by the Client in accordance with the legal acts of the Republic of Estonia. The Client is responsible for provided information and all the consequences that may arise from the information provided.
6.3 Neither party is liable to the other party for any damages or delay in meeting these Terms and conditions if it was caused by circumstances that neither party could influence or foresee (force majeure). Failure to fulfil the obligations of the parties under force majeure circumstances is not a violation of these general terms and conditions.
6.4 For description of force majeure Standard ICC (International Chamber of Commerce) Force Majeure clause to apply.
6.5 nordichills.eu does not compensate for moral damage that caused by change of prices, product delivery time, etc in the framework of the present general Terms and conditions.
6.6 nordichills.eu does not refund the client's expenses caused by circumstances when the Client undertakes an obligation before third parties (independent from nordichills.eu) on conditions contradicting the present general Terms and conditions.
6.7 nordichills.eu will not reimburse for the Client any loss of profit, consequential or other economic loss due to changes in prices, delivery times, etc.
6.8 nordichills.eu is not responsible for interruptions in the provision of services, delays, errors and failures in the operation of the website resulting from violations in the work of third parties, service and postal companies, as well as violations resulting from force majeure beyond the control of nordichills.eu.
6.9 The maximum amount of compensation may be the cost of the product and delivery ordered by the Client in www.nordichills.eu online store.

7. PRIVACY POLICY
7.1 When using the website www.nordichills.eu the Client gives clear and deliberate consent to the use of personal data by nordichills.eu.

7.5 In case of disagreements or disputes arising from the implementation of these Terms and Conditions, the parties, first of all, try to reach an agreement through negotiations. If the disputes can not be solved by negotiations, both parties (both Client and nordichills.eu) are entitled to apply to the Department of Consumer Protection or the court for protection of their rights.

8. FINAL PROVISIONS
8.1 These general terms and conditions of use of www.nordichills.eu online store are regulated by the laws and legal acts of the Republic of Estonia.
8.2 If any of the provisions of these general terms and conditions is not valid, this does not affect the validity of the other provisions of the general terms and conditions and may be replaced by a provision that is closest to it in legal and economic terms.
